Public views open on new strata rules

The Attorney-General’s Department (AGD) has invited the public to share their views on proposed changes to the Community and Strata Titles Acts and the draft Community Titles (Resolutions) Amendment Regulations.

According to the AGD, the changed Regulations may address recent concerns about the ability of community corporations to respond promptly, to notices for replacing flammable cladding, and other building rectification notices.

The Department is seeking public feedback before the proposedly changed Acts and Regulations are put to Parliament.

“This is in light of the current requirement to obtain a unanimous resolution of owners to agree to the community corporation expending the costs of rectification works if they exceed the specified threshold per apartment,” the Department said,

“The consultation provides an opportunity to incorporate any additional changes needed to the legislation before the Bill is introduced in Parliament,” it said.

An announcement was made recently that the ‘Combustible Aluminium Composite Panel Cladding – Limited Loan Scheme’, is to offer eligible owner-corporations loans to do cladding remediation and removal works on their apartment buildings.

The Department said the proposed Regulations would provide that only a special resolution of owners is required for a community corporation to expend an amount exceeding the prescribed $5,000 per lot/ apartment threshold, where the expenditure is for completing works required by a council or public authority.

It said it would consider submissions to finalise the draft Bill for introduction in Parliament and to finalise the Regulations to be made in Executive Council.

The Attorney-General’s Department encourages people to have their say before the consultation closes on Friday, 6 January.
