The Gaming and Wagering Commission (GWC) has recommended that an independent inquiry under the Casino Control Act 1984 be established to investigate matters uncovered by the Bergin Inquiry into the operations of the Crown Perth casino
The Commission has asked the State Solicitor’s Office to prepare terms of reference for the inquiry.
In a statement, the GWC says its seeks to establish the suitability of Crown Perth as a casino gaming licence operator in WA; the suitability of close associates, and the appropriateness of Crown Perth’s responses to the GWC prior to and during the Bergin Inquiry.
It also wants to consider the effectiveness of the Department of Local Government, Sport and Cultural Industries and the GWC in the discharge of their regulatory responsibilities, inclusive of any perceived conflicts of interest.
Finally, it seeks recommendations on potential legislative amendments or regulatory controls that would address strategic risks identified in the Bergin Inquiry.
The GWC is recommending that the inquiry have the powers of a Royal Commission as opposed to the general powers of one of its investigations.
“The GWC acknowledges the seriousness of the Bergin Inquiry findings and has been working co-operatively with the Bergin Inquiry,” the GWC said in the statement.
“In addition, the GWC determined that directions under the Casino Control Act 1984 are to be prepared…to prohibit junket operations at Crown Perth and requiring the casino operator to obtain Commission approval to establish gaming bank accounts.”
The GWC noted that WA Chief Casino Officer, Michael Connolly had made a formal declaration of an interest due to his personal associations with staff at Crown Perth.
”In consideration that there should be no perception of a conflict of interest, Mr Connolly volunteered to step aside from his role as Chief Casino Officer effective immediately,” the Commission said.
“Mark Beecroft assumed the role to assist the GWC with its response to the inquiry report and this was confirmed by the GWC at its meeting,” it said.
