Duties: The International Crime Cooperation Central Authority (ICCCA) is responsible for administering Australia’s formal international crime cooperation obligations under the Extradition Act 1988 and the Mutual Assistance in Criminal Matters Act 1987. The Litigation Unit has carriage of ICCCA’s in-house legal practice, which is responsible for the conduct of extradition and mutual assistance administrative proceedings before judicial officers on behalf of requesting countries, and judicial review of decision-making relevant to international cooperation matters, operating on the basis of direct briefing, as well as engaging external legal representatives. In addition, the Litigation Unit is responsible for document production requests and associated litigation.
Senior Legal Officers in the Litigation Unit provide essential support to the Director (Litigation) for matters in court, supervise Legal Officers, and are responsible for managing a number of extradition cases (being the primary workload of the section). Senior Legal Officers work collaboratively with the extradition and mutual assistance casework teams, as well as external stakeholders including law enforcement and prosecutorial authorities, and foreign governments.
The role predominantly involves:
- Preparing matters for litigation, such as drafting briefs to counsel, court documents, written submissions, and conducting legal research.
